TERMS OF SERVICE

These Terms of Service govern your use of the Printex Utah website and your purchase of products or services from Printex Utah. By visiting our website, submitting a quote request, approving artwork, placing an order, or purchasing a product or service, you agree to these Terms of Service.
Throughout these Terms, “Printex Utah,” “we,” “us,” and “our” refer to Printex Utah. “Customer,” “you,” and “your” refer to the person or business requesting or purchasing products or services.
1. OUR SERVICES
Printex Utah provides custom printing and decoration services, including screen printing, embroidery, DTF transfers and gang sheets, leather patch hats, heat-transfer vinyl, custom apparel, stickers, banners, business cards, flyers, magnets, graphic design, and related products and services.
Service availability, minimum quantities, pricing, production times, and product options may vary depending on the project.
2. ELIGIBILITY AND ACCURATE INFORMATION
You must provide accurate, complete, and current information when submitting an order, requesting a quote, or creating an account.
You are responsible for confirming:
• Customer and business information
• Email address and telephone number
• Billing and shipping information
• Product styles, colors, sizes, and quantities
• Artwork, spelling, dates, and design details
• Print or embroidery locations
• Required completion or event dates
Printex Utah is not responsible for delays or errors caused by incomplete, inaccurate, or outdated information supplied by the customer.
3. QUOTES AND PRICING
Quotes are based on the information available when the quote is prepared. Pricing may change if the customer changes the quantity, product, sizes, artwork, colors, decoration method, print locations, finishing requirements, shipping method, or deadline.
Unless stated otherwise, a quote does not reserve inventory, production time, or pricing until the required payment or deposit has been received.
Obvious typographical, technical, or pricing errors may be corrected before an order is accepted. If an error affects an order already submitted, we will contact the customer before proceeding.
Applicable taxes, shipping charges, setup fees, design fees, rush fees, oversized garment charges, and other project-specific costs may be added to the order.
4. PAYMENTS AND DEPOSITS
Printex Utah may require a deposit or full payment before ordering products, preparing artwork, or beginning production.
The required balance must be paid according to the terms shown on the quote or invoice. Completed orders may be withheld until the outstanding balance is paid in full.
Deposits may become non-refundable after artwork preparation begins, merchandise is ordered, supplies are purchased, or production is scheduled or started.
Chargebacks or payment disputes should not be initiated before giving Printex Utah a reasonable opportunity to investigate and resolve the issue.
5. CUSTOM ORDERS
Custom and personalized products are manufactured specifically for the customer. Customers must carefully review all order details before approval.
Once artwork is approved, merchandise is ordered, or production begins, changes may not be possible. Requested changes may result in additional costs and a revised completion estimate.
Custom products are generally final sale except when Printex Utah confirms a defect or production error covered by our Return and Refund Policy.
6. ARTWORK REQUIREMENTS
Customers must provide artwork in an appropriate format and resolution for the selected production method.
Printex Utah may request higher-resolution files, vector artwork, transparent backgrounds, separated colors, embroidery-ready files, or other adjustments before production.
Files displayed on a phone, computer screen, mockup, or digital proof may appear different from the final physical product due to screen settings, materials, inks, threads, printing methods, and lighting.
Submitting artwork does not mean that it has been approved as production-ready. Printex Utah staff may review the artwork and request corrections.
7. ARTWORK OWNERSHIP AND AUTHORIZATION
By submitting artwork, logos, photographs, names, trademarks, slogans, characters, or other content, you represent that you own the content or have permission to reproduce and use it.
You are responsible for obtaining all required licenses, releases, and permissions.
Printex Utah may refuse or cancel work that appears to violate copyrights, trademarks, privacy rights, publicity rights, applicable laws, or third-party rights.
You agree to be responsible for claims, losses, or expenses resulting from content that you submitted without proper authorization.
Unless otherwise agreed in writing, payment for printing or production does not transfer ownership of Printex Utah’s original concepts, working files, editable source files, production files, digitized embroidery files, templates, or proprietary processes.
8. ARTWORK PROOFS AND APPROVAL
When a proof is provided, the customer must review:
• Spelling and grammar
• Names and numbers
• Design content
• Colors
• Dimensions and proportions
• Product style and color
• Sizes and quantities
• Print or embroidery locations
• Overall layout
Approval confirms that the customer accepts the visible design and order details.
Printex Utah is not responsible for customer-provided errors or errors visible in an approved proof.
Changes requested after approval may require additional design, setup, material, or production charges.
9. COLOR, SIZE, AND PLACEMENT VARIATIONS
Exact color matching is not guaranteed unless a specific matching service has been approved in writing.
Colors may vary between screens, printers, inks, threads, garments, material batches, manufacturers, and production methods.
Garment measurements and colors may vary slightly by manufacturer, style, size, or production batch. Customers are responsible for reviewing available size charts before approving an order.
Custom production may include reasonable variations in print placement, embroidery placement, dimensions, texture, pressure, registration, and appearance. Minor variations that are normal for the production method are not considered defects.
10. PRODUCTION TIMES
Production estimates begin only after:
• Required payment or deposit has been received
• Artwork and order details have been approved
• Product availability has been confirmed
• All required customer information has been received
Production estimates are business-day estimates and generally exclude weekends, holidays, shipping time, customer approval delays, supplier delays, and events outside our reasonable control.
A preferred date, event date, or requested deadline is not guaranteed unless Printex Utah confirms it in writing.
11. RUSH ORDERS
Rush service is subject to approval, product availability, artwork readiness, production capacity, and the requirements of the order.
A rush fee may apply. Rush fees are generally non-refundable once the order has been accepted and scheduled.
Submitting a rush request or paying for expedited shipping does not guarantee that production can be completed by a particular date unless confirmed by Printex Utah.
12. PRODUCT AVAILABILITY AND SUBSTITUTIONS
Products may become unavailable, discontinued, delayed, or backordered without notice.
If an approved item becomes unavailable, Printex Utah may contact the customer to approve a comparable substitute, revised schedule, partial fulfillment, or refund for the unavailable item.
We will not knowingly substitute a materially different product without customer approval.
13. CUSTOMER-SUPPLIED PRODUCTS
Customer-supplied garments or products are accepted at the customer’s risk.
Printex Utah is not responsible for:
• Pre-existing damage, stains, or defects
• Manufacturer inconsistencies
• Incorrect labeling or sizing
• Products unsuitable for the selected process
• Heat-sensitive coatings or materials
• Dye migration, discoloration, scorching, shrinkage, or distortion
• Hidden defects that become visible during production
• Replacement value beyond an amount approved in writing
We may refuse customer-supplied items that we believe cannot be decorated safely or reliably.
14. DTF TRANSFERS AND CUSTOMER APPLICATION
Customers purchasing transfers for self-application are responsible for confirming garment compatibility and using the correct equipment, temperature, pressure, pressing time, peeling method, and finishing instructions.
Test pressing is recommended before completing a full production run.
Printex Utah is not responsible for damage caused by improper storage, application, equipment calibration, garment incompatibility, user error, or failure to follow application instructions.
Customers must inspect transfers before applying them. Applied or heat-pressed transfers generally cannot be returned unless Printex Utah confirms that the transfer was defective before application.
15. PICKUP, SHIPPING, AND DELIVERY
Local pickup orders should not be collected until the customer receives confirmation that the order is ready.
Customers are responsible for providing an accurate delivery address. Additional costs caused by an incorrect or incomplete address may be charged to the customer.
Shipping and delivery dates are estimates unless specifically guaranteed by the carrier. Printex Utah is not responsible for carrier delays, weather delays, missed delivery attempts, theft after confirmed delivery, or delays outside our reasonable control.
Customers must promptly report lost, damaged, or missing shipments so that available carrier claims can be reviewed.
If merchandise cannot be shipped within the promised or legally permitted period, Printex Utah will provide any notice, cancellation opportunity, or refund required by applicable law.
16. ORDER INSPECTION AND PROBLEMS
Customers should inspect orders promptly after pickup or delivery.
Defects, shortages, or alleged Printex Utah production errors must be reported within 7 calendar days. The report should include the order number, description of the issue, affected quantity, and clear photographs.
Affected products should not be worn, washed, altered, sold, applied, or used before Printex Utah reviews the claim.
Approved remedies may include repair, reprinting, replacement, account credit, or refund of the affected items, depending on the circumstances and applicable law.
17. RETURNS, REFUNDS, AND CANCELLATIONS
Returns, refunds, exchanges, deposits, and cancellations are governed by our Return and Refund Policy, which forms part of these Terms.
Custom, personalized, printed, embroidered, decorated, and made-to-order products are generally final sale after approval or production begins.
Nothing in these Terms limits rights that cannot legally be waived.
18. WEBSITE AND PRODUCT INFORMATION
We attempt to present accurate product descriptions, images, prices, availability, and service information. However, we do not guarantee that all website content will always be complete, current, or error-free.
Product images are illustrative. Actual colors, dimensions, finishes, materials, and appearance may vary.
We may correct errors, update information, modify products, or cancel orders affected by a material error, subject to applicable law.
19. ACCOUNTS AND SECURITY
Customers are responsible for maintaining the confidentiality of their account credentials and restricting access to their devices.
Notify Printex Utah promptly if you suspect unauthorized access to your account.
We may suspend or terminate accounts used for fraud, abuse, unlawful activity, payment disputes made in bad faith, harassment, or violations of these Terms.
20. PROHIBITED USES
You may not use our website, products, or services:
• For unlawful or fraudulent purposes
• To violate intellectual-property or privacy rights
• To submit malicious code or interfere with website security
• To collect information about others without authorization
• To harass, threaten, discriminate against, or harm another person
• To impersonate another person or business
• To submit deceptive payment or account information
• To reproduce content for which you do not have permission
We may refuse service or cancel an order when reasonably necessary to address unlawful, unsafe, fraudulent, abusive, or infringing activity.
21. THIRD-PARTY SERVICES
Our website may use or link to services provided by Shopify, payment processors, shipping carriers, product suppliers, applications, and other third parties.
Third-party services may be governed by their own terms and policies. Printex Utah is not responsible for third-party websites or services outside our reasonable control.
22. DISCLAIMER
To the fullest extent permitted by applicable law, products and services are provided without warranties beyond those expressly stated in writing.
We do not guarantee that the website will always be uninterrupted, secure, or error-free.
This section does not exclude warranties, remedies, or consumer rights that cannot legally be excluded.
23. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Printex Utah will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost business, lost data, or missed events, arising from use of the website or purchase of products or services.
Where liability cannot be excluded, Printex Utah’s liability will be limited only to the extent permitted by applicable law.
24. INDEMNIFICATION
To the extent permitted by law, you agree to defend and hold Printex Utah harmless from third-party claims arising from artwork or content you supplied, your unauthorized use of intellectual property, your violation of these Terms, or your violation of another person’s rights.
25. SEVERABILITY
If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in effect. The affected provision will be enforced to the maximum extent permitted by law.
26. NO WAIVER
Failure to enforce a provision of these Terms does not waive the right to enforce it later.
27. GOVERNING LAW
These Terms and transactions with Printex Utah are governed by applicable federal law and the laws of the State of Utah, without limiting any consumer protections that apply under other applicable law.
28. CHANGES TO THESE TERMS
We may revise these Terms from time to time. The updated version becomes effective when published, unless applicable law requires otherwise.
The Terms in effect when an order is accepted generally apply to that order.
